Nike. McDonald’s Apple. These companies and many others invest millions of dollars each year protecting that one thing that distinguishes them in the marketplace – a trademark. A company’s trademark is the symbol that allows consumers to know that they are dealing with a particular company. This article addresses the extent to which some companies will go to obtain and protect a trademark. Specifically, it will address the fight between Cisco and Apple over the iPhone trademark, as both companies took (...) questionable steps in the United States and abroad to obtain rights to the iPhone mark. In addition, the basics of trademark law and ethical theories relevant to trademark law will be addressed. (shrink)

There are two fundamental self-regulatory systems for moral action reflecting an approach-oriented system promoting moral action (prescriptive morality) and an avoidance-oriented system restraining immoral action (proscriptive morality). Despite the presence of these systems, individuals may vary in the extent to which the systems regulate their moral responses. One factor that may heighten prescriptive and proscriptive moral self-regulation is individuals’ moral identity. Three studies examined if the systems of moral regulation are more salient among individuals with a strong internalized moral identity. (...) Possessing a strong internalized moral identity was associated with greater salience of the prescriptive system – with heightened perceptions that prescriptive behaviors should be enacted, that prescriptive behaviors are less a matter of personal preference, and that prescriptive behaviors are expected to yield greater social approval – compared to the proscriptive system. Possessing a strong internalized moral identity appears to orient individuals toward engaging in good (rather than only avoiding bad) behaviors. (shrink)

Extending previous research on the characteristics associated with adolescents’ general tendency to be a moral rebel, the present study examined the roles of moral identity and moral courage characteristics on 3 expressions of the tendency to stand up for one’s beliefs and values despite social pressure not to do so. Results revealed that general and situation-specific moral courage characteristics are important motivators of individuals’ caring, just, and brave expressions of the tendency to be a moral rebel, especially when they possess (...) a relatively strong moral identity. Over recent years, the research community has been increasingly using preprint servers to share manuscripts that are not yet peer-reviewed. Even if it enables quick dissemination of research findings, this practice raises several challenges in publication ethics and integrity. In particular, preprints have become an important source of information for stakeholders interested in COVID19 research developments, including traditional media, social media, and policy makers. Despite caveats about their nature, many users can still confuse pre-prints with peer-reviewed manuscripts. If unconfirmed but (...) already widely shared first-draft results later prove wrong or misinterpreted, it can be very difficult to “unlearn” what we thought was true. Complexity further increases if unconfirmed findings have been used to inform guidelines. To help achieve a balance between early access to research findings and its negative consequences, we formulated five recommendations: (a) consensus should be sought on a term clearer than ‘pre-print’, such as ‘Unrefereed manuscript’, “Manuscript awaiting peer review” or ‘’Non-reviewed manuscript”; (b) Caveats about unrefereed manuscripts should be prominent on their first page, and each page should include a red watermark stating ‘Caution—Not Peer Reviewed’; (c) pre-print authors should certify that their manuscript will be submitted to a peer-review journal, and should regularly update the manuscript status; (d) high level consultations should be convened, to formulate clear principles and policies for the publication and dissemination of non-peer reviewed research results; (e) in the longer term, an international initiative to certify servers that comply with good practices could be envisaged. Trolling—the online exploitation of website, chat, or game mechanics at another user's expense—can and does take place all over cyberspace. It can take myriad forms, as well—some verbal, like trash-talking an opponent in a game, and some silent, like refusing to include a new player in a team effort during an in-game quest. However, despite this variety, there are few to no studies comparing the effects of these differing trolling types on victims. In addition, no study has yet taken into (...) account users' offline cultural context and norms into the trolling victim experience. To fill this gap in the literature, the present study put participants from three culturally-distinct countries—Pakistan, Taiwan, and the Netherlands—in a simulated trolling interaction using the Cyberball game. Participants were either flamed or ostracized by a member of their own cultural group or a minority member, and the participants' emotional responses, behavioral intentions toward the other players, and messages sent during the game were taken as indicators of their response to the trolling. Results showed that our Taiwanese sample used the most reactive aggression when trolled and our Dutch sample was the most passive. In addition, ostracism generally produced the desire to repair relationships, irrespective of cultural context, and perpetrator culture only produced an effect in the behavioral intentions of our Pakistani sample. Overall, it would appear that online and offline culture interact to produce the variety of responses to trolling seen in extant literature. Additional implications for future research into computer-mediated communication and online aggression are also discussed. (shrink)

Scott Blanchard The morality of thought lies in a procedure that is neither entrenched nor detached. --Theodor Adorno Perhaps no author within or outside of the canon of Western literature wrote as extensively on the topic of solitude as did Francesco Petrarch. While many of our modern associations with (...) the term may find some of their origins traceable as far back as Petrarch's career, the term "solitude" carried with it much different associations in his century than it does for us today, influenced as we are by the Romantic tradition and especially by Wordsworth's absorption with the idea of solitude as an ideal state for self-conscious reflection on the individual's personal history and its meaning. No less than three of Petrarch's major prose works--the De otio religioso, the De vita solitaria, and the Secretum--confront the topic of solitude directly, and we can also point to many letters, poems, and portions of his treatises that either directly or indirectly reflect Petrarch's virtual obsession with solitude. In Petrarch we are confronted with an author who was at once the most politically connected intellectual of his century--we are even tempted to call him a "public intellectual"--and yet who constantly invoked his desire for solitude, for an escape from the many distractions and seductions that the cities and courts of his society offered. For Petrarch these were invariably places where desire lurked and power held sway, so that the life of solitude was often invoked as an alternative--a counter-cultural locus, perhaps--where freedom from temptation and subjection was imagined as an escape from the negotium of worldly life. There is much in Petrarch's writings on the solitary life that is wishful and that we might characterize as merely compensatory in a life that was otherwise quite active and engaged, but there is also a [End Page 401] strain of thought in these works that indicates a certain intransigence beneath Petrarch's overdetermined attachment to the idea, if not the practice, of withdrawal and detachment. An inquiry into Petrarch's idealization of the solitary life may even yield a somewhat reactionary aspect of his complex mind, a conservative strain in an author who was in almost every other way the literary herald of a humanism that was at the center of the cultural avant-garde of the Trecento. Is the Petrarch that in so many accounts of his character is construed as the "first modern man" actually something else, a reluctant ascetic holdover from the Middle Ages? How did Petrarch use his unique understanding of the life of solitude, of ascesis, as a pose from which to construct his sense of himself as an author and intellectual? Or are we simply confronted in the figure of a worldly and an ascetic Petrarch with yet another set of contradictions so appropriate to the "immensely complex" author whose poetic signature was the oxymoron? 1"Asceticism" and "solitude" are of course not synonymous terms, but any examination of a number of Petrarch's works as they fall within what might be called a genealogy of asceticism must recognize from the start that Petrarch's brand of asceticism was somewhat unique, especially insofar as it was deeply influenced by ancient Stoicism as well as by his reading in authors from the early Christian era. Sir arthur edington's brilliantly phrased article, “Physics and Philosophy,” which appeared in the January 1933 issue of Philosophy, seems to me to contain a number of things which are calculated to be provocative to the mere philosopher. And I propose in this article to discuss what appears to be one of the most important of these provocative things, namely, Sir Arthur's view of the status of the physical world.

Theism is a modern word, meaning belief in God. But there is no unanimity about the attributes of God. The Greek theos meant a superhuman and in particular an immortal Being. For the Platonists he was a “Soul,” and there may be more than one soul. The Christian Fathers—Augustine as well as the Greeks, could say without reproach that God became man in order that man might become divine. Until fairly recently a common way of doing history of science was to pick up an important strand of contemporary scientific thought and to trace its origin back to the philosophical tangle of the scientific revolution. This approach conveniently by-passed the breakdowns of once useful and pervasive theories, and neglected the long intellectual journeys along devious routes. History of science read like a success story; the pioneers who failed were neither dismissed nor excused; they were simply ignored. The historian knew (...) what he was hunting for and he was careful to limit his search to areas where his quarry was sure to be found. This method, which has been dubbed the precursor-view, stands in contrast—albeit, not in opposition—to the contextual method, which aims at a better understanding of the actual thought-processes of the early scientists. On this second view, history of science must not only account for present theories in the light of past developments, it must also assess old theories in terms of the scientist's conceptual framework, and judge them against the background of the world picture of his age. This may lead the historian down the blind alleys of the past, chasing spurious attempts at explaining the nature of physical reality, but it can clear the ground for a less anachronistic interpretation of the emergence of modern science and the actual process of discovery. History of science acts as a winnowing fork, but we cannot suppose that the discoverer himself always separated the wheat from the chaff, and we must be ever wary of equating the dream with the task. In terms of validity in Kripke frames, a modal formula expresses a universal monadic second-order condition. Those modal formulae which are equivalent to first-order conditions are called \emph{elementary}. Modal formulae which have a certain persistence property which implies their validity in all canonical frames of modal logics axiomatized with them, and therefore their completeness, are called \emph{canonical}. This is a survey of a recent and ongoing study of the class of elementary and canonical modal formulae. We summarize main ideas and (...) results, and outline further research perspectives. (shrink)

Computational functionalism [5] fails to understand the embodied and situated nature of behaviour by taking steady state functions as theoretical primitives, and by interpreting cognitive behaviour from a language-like, observer dependant framework without a naturalized normativity. Evolutionary functionalism [28, 27], on the other hand, by grounding functional normativity on historical processes fails to give an account of normative functionality based on the present causal mechanism producing behaviour. We propose an alternative autonomous dynamical framework where functionality is defined as contribution to (...) self-maintenance [15, 10, 35] and normativity as satisfaction of closure criteria. We develop this framework by a set of formal definitions in the framework of dynamical system theory and propose the hypothesis of an homeostatic-plasticity [31, 40] based general purpose value system as an internalized normative mechanism that selects between internal state trajectories to produce adaptive functionality under different environmental conditions. To test the hypothesis we develop a simulation model where lower level specifications of a control arquitecture (an homeostatic plastic DRNN) give rise (through a simulated evolutionary process) to adaptive behaviour in a foraging task where food sources can be poisonous or profitable. Analysis of the evolved agent show that plastic changes occur when the agent produces salient adaptive interactions, those plastic changes determining the adaptive strategy. The embodied and interactive adaptive functionality is dynamically analysed, illustrating the autonomous dynamical framework. (shrink)
